Losing someone you love to another person’s negligence is devastating. The legal questions that follow — who can file, what the claim covers, what it might recover — come at the worst possible moment. At Dashner Law Firm | Arlington Injury & Accident Attorney, we work with families across Arlington and throughout Texas who are facing exactly that situation. This post walks through how these claims actually work — what goes into the valuation, how attorneys handle specific circumstances like a child’s death or a defective product, and what to look for when choosing a lawyer.

How Attorneys Determine the Value of a Wrongful Death Claim in Arlington?

This is the question most families ask first, and the honest answer is that no two cases produce the same number. What an attorney actually does is build two separate legal frameworks side by side: the wrongful death claim and the survival action.

Under Texas law — specifically Tex. Civ. Prac. & Rem. Code § 71.004 — a wrongful death action exists for the benefit of the surviving spouse, children, and parents of the person who died. Those beneficiaries can seek compensation for their own losses: the financial support the deceased provided, the loss of companionship and society, mental anguish, and the loss of inheritance caused by the early death. These are the beneficiaries’ losses, not the estate’s.

The survival action under § 71.021 is a separate claim that continues the cause of action the deceased person held at the moment of death. It belongs to the heirs, legal representatives, or estate. This is where pre-death medical expenses — the amount actually paid or incurred under Tex. Civ. Prac. & Rem. Code § 41.0105 — and the deceased person’s own pain and suffering before death are properly placed. Conflating the two claims is one of the most common errors I see in early-stage consultations, and it can affect how damages are presented to a jury.

Once those two tracks are separated, the attorney builds a damages picture for each. For the wrongful death side, that means documenting the deceased’s income history, likely career trajectory, household contributions, and the nature of the relationships at stake. Economists are often retained to project lost financial support. Mental anguish damages require evidence — medical records, testimony from family members, sometimes a mental health professional’s assessment.

On the survival side, the attorney gathers hospital and treatment records, invoices, and any documentation of what the person experienced between the injury and death.

Fault is also part of the equation. Texas uses proportionate responsibility under Tex. Civ. Prac. & Rem. Code § 33.001. If the deceased person bore some share of fault, the recovery is reduced by that percentage. If their share of responsibility is found to be more than 50 percent, the claim is barred entirely. In my experience, defendants and their insurers will raise this issue aggressively, so the attorney’s job is to build a fact record that minimizes any assignment of fault to the deceased.

Punitive damages — called exemplary damages in Texas — may be available if there is clear and convincing evidence of fraud, malice, or gross negligence, and only with a unanimous jury. They are not automatic for any category of conduct. Under Tex. Civ. Prac. & Rem. Code § 41.008(b), they are generally capped at the greater of $200,000, or two times economic damages plus noneconomic damages up to $750,000. There is an exception under § 41.008(c) for claims based on certain enumerated felony conduct — including intoxication manslaughter — where that cap does not apply.

Families in Arlington typically have two years from the date of death to file, under Tex. Civ. Prac. & Rem. Code § 16.003. If a government entity is involved — a city vehicle, a public school bus, a municipal employee — the rules change materially, and written notice to the governmental unit is required within six months under § 101.101. Do not assume the standard two-year period applies if any government party is on the other side.

How Accident Attorneys Assist with Wrongful Death Claims?

Most people think of a wrongful death lawyer as someone who handles paperwork. The actual work is far more involved. After taking on a case, our team immediately begins preserving evidence — accident scene data, vehicle black box recordings, surveillance footage, cell phone records, employer records for the at-fault party. Evidence disappears faster than most families realize, especially in commercial trucking cases where data retention policies may purge records within weeks.

Attorneys also identify all potentially liable parties. A single fatal accident may involve a driver, an employer, a vehicle manufacturer, a property owner, and an insurance carrier, each with separate legal exposure. Missing one of those parties early can cost the family real money.

Beyond the legal mechanics, attorneys coordinate with economists, medical professionals, and forensic experts to build the damages case. They also handle communications with insurance adjusters, who will typically contact surviving family members directly and quickly. Anything a family member says to an adjuster can be used to limit or deny the claim. One of the first things I tell clients is to direct all insurer communications to our office.

How Attorneys Handle Wrongful Death Claims Involving Children?

These cases are among the hardest I handle. They are also legally distinct in ways that matter.

When a child dies, the recoverable damages look different. A child typically has no earnings history, no dependents, and no financial track record. What the parents can recover centers on companionship, society, mental anguish, and the loss of the parent-child relationship going forward. These are real damages, but they are not reducible to a spreadsheet, which means how they are presented — through testimony, records, and narrative — carries enormous weight.

Texas courts have affirmed substantial mental anguish awards for parents in these cases. The attorney’s job is to help the parents articulate and document their grief and loss in terms a jury can evaluate. That is not a comfortable process, but it matters.

Procedurally, a child cannot bring or settle claims on their own behalf. If there is a survival action alongside the wrongful death claim, any settlement involving a minor’s estate may require court approval, depending on the structure. Our team makes sure the procedural requirements are handled correctly so the family is not exposed to later challenges.

The American Bar Association notes that child injury and wrongful death cases require particular care in damages presentation precisely because the economic framework used in adult cases does not translate directly. Attorneys experienced in these cases know how to present non-economic losses to a jury without letting the defense reduce the entire case to a number they find acceptable.

How to Find Experienced Wrongful Death Attorneys in Texas?

The state bar is one starting point. The State Bar of Texas maintains a directory, and FindLaw and Justia both allow you to search by practice area and location. But directory listings tell you very little about actual courtroom and negotiation experience.

What I look for when evaluating any attorney’s background in this area:

Actual trial experience matters. Many personal injury firms settle every case. A lawyer who has never taken a wrongful death case to verdict does not know how the evidence will play in front of a jury, and defendants’ attorneys know when they are dealing with someone who will fold before trial. Ask directly whether the attorney has tried wrongful death cases and what happened.

Resources matter too. Building a credible wrongful death case requires economists, reconstruction experts, and sometimes medical examiners. Smaller firms without those relationships may lack the infrastructure to mount a full damages case.

You should also review what clients say. Our verdicts and settlements page reflects the kind of outcomes our team has pursued for families. Past results never guarantee a future outcome, but they tell you whether a firm has actually handled cases of meaningful scale.

Ask about the attorney’s role. At some firms, a named partner signs the intake paperwork and a less experienced associate handles everything from that point forward. That is not necessarily wrong, but you should know going in who is actually working your file.

How to Choose a Wrongful Death Attorney for a Defective Product Claim in Texas?

Product liability wrongful death cases have a distinct legal structure. The claim typically runs under theories of design defect, manufacturing defect, or failure to warn. These cases require technical evidence — engineering analysis, internal company communications, regulatory records — that a general personal injury attorney may not know how to develop.

Texas follows the Restatement (Second) of Torts § 402A framework for strict liability in product cases, alongside negligence theories. Understanding which theory fits the facts — and what evidence each requires — shapes how the case is investigated from day one.

When selecting an attorney for a product-related wrongful death, look for someone who has retained and worked with engineering and product safety experts before, not just medical or accident reconstruction experts. Ask how many product defect cases they have taken through the discovery phase, because that is where the case is usually won or lost. These cases generate enormous document productions, and attorneys without experience in that process can get buried.

Our Texas Product Defect & Liability Attorneys page covers the full scope of what these claims involve. The CDC’s National Center for Health Statistics tracks consumer product-related fatalities, which can provide context when a product has a broader pattern of harm — something that strengthens both the individual case and any potential for broader accountability.

Defective product cases sometimes involve multiple defendants: the manufacturer, a component supplier, a distributor, a retailer. An attorney handling this type of wrongful death claim needs to be comfortable coordinating across multiple defendants and their separate legal teams.

How to Choose a Wrongful Death Attorney for a Truck Accident Claim in Texas?

Fatal truck accidents are factually and legally different from passenger vehicle crashes. Federal Motor Carrier Safety Administration regulations govern commercial trucking operations, and violations of those regulations — hours of service, maintenance logs, driver qualification files, cargo securement — can be central to proving the carrier’s liability. An attorney who does not know those regulations in detail is working at a disadvantage from the start.

Evidence preservation in these cases is urgent. Electronic logging devices, GPS data, dashcam footage, and driver qualification files must be requested immediately, often through a legal hold letter sent before any lawsuit is filed. The Federal Motor Carrier Safety Administration requires carriers to maintain certain records for specified periods, but those periods are finite, and some data disappears faster than the regulatory minimum suggests.

Trucking companies typically have specialized defense firms and adjusters on the scene within hours of a serious crash. They are gathering evidence before the family has spoken to a single attorney. That asymmetry is real, and it is one reason that early retention of a Texas Truck Accident Attorney matters.

Ask any prospective attorney how many fatal commercial truck accident cases they have handled, whether they have experience with FMCSA regulations, and who specifically on their team handles trucking defense. The Bureau of Labor Statistics has noted that transportation occupations account for a disproportionate share of fatal workplace incidents, which reflects the scale of commercial trucking operations in Texas and the frequency with which these cases arise.

If the crash involved intoxication by the truck driver, exemplary damages may be available and the statutory cap may not apply under § 41.008(c). That changes the settlement calculus significantly, and an attorney experienced in trucking cases will know how to develop and present that evidence.
